Still guilty according to the CSA

Some time ago I wrote a story about how the CSA made me guilty until proven innocent.  It is now two years on and I have had just about enough of the situation.

A fair number of you literally thought I was evil because I said that the problem is her fault and not mine.  Well I decided to take your advice people.  I went to the CSA and said I want a DNA paternity test so I will know for sure whether or not I am the father.  Maybe then I could have some sort of normality back in my life and perhaps be a father to a child (because society makes you?)

Two years later and about 40 plus letters - still no solution.  To really top it all off the CSA have given my details out to the PWC (parent with care); my address, telephone number, even my place of work and current salary.  The PWC has contacted me and called me all the names under the sun; she said I'm just stalling the CSA and telling them to stop bothering me.  All this despite the fact that all the letters I have sent have merely said that I want a DNA test as soon as possible. Not once have I stalled them or used stalling tactics - I JUST want a DNA test!

The CSA has also demanded that I pay £3,000 one month, then £4,000 to be paid in 7 days or it will effect my credit rating and my home maybe repossessed.

Even after many pointless conversations and complaints, the CSA still wont listen and still wont help in resolving the matter.  I have done everything in my power to sort out the issue, going to court is the last option and one I really don't like the sound of.

I have actually moved home out of safety concerns for myself and my family.  As I said in my previous story, I don't know this girl, she appears to be hell bent on lying to the CSA and maybe she is the root of the problem?

It doesn't matter what you do, run and hide, or hit them head on with all the advice and morality in the world; you're still treated like a criminal, you're still fighting a ghost and a faceless system!  The child isn't even going to be three this year and I can just see him turning thirteen before this problem is ever resolved.

UPDATE:- I have now got a DNA test next week. Its taken over 3 years to sort, an MP, 47 letters, 16 hours of telephone calls... which just goes to prove that us men have no rights when it comes to family. We are second class citizens in our own homes.

How do I stop the DOE, and how do I push a DNA test?

Thank you for the advice. Please come to our website by the way www.didnthaveachoice.com go to the forum and sign up. Your advice would be greatly appreciated there too. The didnt have a choice website started for people like Me where we, didnt have a choice in the matter and got sprung on by the CSA made to pay, with out any conslutation on whether we are the actualy parents and if we are, why do we have to pay for a child we did not choose to have. We have evolved somewhat since, but still hold the princaple that the CSA needs to be scrapped and every case run throw the courts. well at least I feel this should be done. Hope you can make it there and anyone else.

Well because you either didn't fill in the MEF or didn't repond to phone calls they will have traced you via either the Inland Revenue (if you are working they can find out who for via National Insurance contributions), Equifax (the credit reference agency who hold your address through any bank accounts you have) or other Government Departments I.e. Jobcentre Plus, Land Registry, DVLA etc. If they manage to track your employer they call them up or fax them for your wage info (employers are required by law to comply with requests from the CSA and other Goverment departments I.e. the police). Once they have this wage info they will perform a maintenance calculation based on your earnings, 15% of your take-home pay if you have one child, 20% if you have 2 or 25% if you have 3 or more. If they are unable to trace a specific employer I.e. agency workers but can prove you're working they will impose what they call a default maintenance decision. It's usually between £30 and £50 a week. Worse still, if you then fail to pay they can set up a Deduction from Earnings Order where they will take the money directly from your wages. Like I say I left because I didn't agree with the system but i'm happy to share any inside knowledge I gained whilst employed there!

Sarah, how can they do a maintenance calculation when I have never filled out the MEF nor have I ever told they my fianacial status.

I used to work for the CSA. I left as I didn't agree with the system in place. Unfortunately as they have already performed an 'MC' (Maintenance Calculation) on your case you are far beyond the means of normal DNA testing. You will have to pay for it yourself now. There are only 3 companies the CSA will accept paternity results from. To be honest they are very VERY expensive as they are what they call a '3 way' test I.e. yourself, your ex partner and your child(ren). I left a couple of years ago and they were costing around £300 - £400 then. The best thing you can do is get in touch with a company called Nacsa- you can google it for the website (not sure if we can post links on here!) They are CSA specialists and will tell you straight what your rights are. I would also mention that the CSA has given out your personal details to your ex as you may be able to do them under the Data Protection Act, all civil servants are bound by this (amongst many other laws). All information is strictly private and confidential, they should not pass your details on to the PWC (Parent with Care) just like they should not pass you on hers. Hope this helps.

I'de get to court as soon as possible, it seems your LAST option to get it resolved. Go armed with DNA result, as long as it's in you favor.

Then if you win your case, SUE the bloody backside off the CSA.
