Dishonest garage sold our car

Our Fiat car (worth approximately £2000) broke down recently and we took it to a small garage in Wolesley Road, Plymouth.  The owner of the garage and two of his mechanics took a look at the car.  They explained briefly what the problem was and then informed us that it would cost more to repair than the car was worth.  They then suggested that the most economical thing to do would be to scrap the vehicle.

Thinking that they were trustworthy professionals we agreed to this and they offered to scrap the car for us free of charge.  So the paperwork was signed and the car was on the way to the scrap yard - or so we thought until about eight weeks later when a man arrived on our doorstep asking if we had a spare key for our old Fiat as he had lost his!

We couldn't believe it when we discovered that the garage had actually advertised the car for £1400 and sold it for £1250.  Now is it just me or have we been ripped off big time and taken for a ride by this garage?  Does anyone know where we might stand legally as consumers on this issue?

Surely they are there to provide us with accurate honest information as per Trading Standards and not to rip off honest hard working people?  Have they not actually acquired a car from us by deception?

May I suggest that to avoid this happening to others you only go to an approved garage and not some back street hustler?  I am sure there are some honest independent garages out there trying to make an honest living, but unfortunately they seem to be in the minority.  Their counterparts are more interested in conning people and making a quick buck rather than offering good old fashioned honest reliable service.

Surely this wouldn't have occured if the sections on the V5C document were correctly filled in and you both took the parts you were supposed to take.

When selling or scrapping a vehicle, always make sure you follow the instructions on the V5C. The current owner should fill the parts in, it shouldn't be handed over and they say "oh, i'll fill it in later and send it off etc". When selling a car, there is a part of the V5C you tear off, you as the owner keep it and the rest of it goes back to the DVLA for the details to be changed and a new V5C sent out to the new owner.

the repairs may be more then the cars worth to you b/c the shop has to charge labor..... but they may be able to fix it and sell it and still make money

so if they get the car free and it's a 1000 repair the cars worth 1500

they can make 500

where you look at the car being worth 1500 why spend 1000 to fix it?

I have been ripped off myself by a mechanic who seized my engine by wrongly fitting a timing belt. That said I would not be happy if I owned one of the many other garages in Wolseley Road. You either keep the garage totally anonymous or name it. As it stands I wouldn't risk going to any garage in that street which is unfair on the honest operators on the same stretch.

Same thing has happened to me fiat car I took it to be repaired to a fiat dealer and they told me it needed a complete engine rebuild and it would cost over £1000, car probably only worth £1500. We signed it over to them to be scrapped but 4 weeks later car looks like it is being repaired and it has not been scrapped. What can we do probably nothing.

Citizens Advice may be able to help you out here. The way I see it you have been mugged for your car using a threat of costs. Terrible situation. Don`t let it drop like some of the posters on here suggest.

work4aliving..... I don't think you get the point here. These people have been told that their property is not worth keeping only to find somebody has sold it on dishonestly. The garage had no right to do anything other than what they told the customer they were going to do. If they said they were scrapping it then that is what they should have done. It is as simple as that!
If I were in their position I would contact the DVLA and inform them that the vehicle was recommended for disposal but is still on the road. I would tell the new owner to return the vehicle to the garage and get their money back, before it is seized as evidence in a private prosecution.
Don't sit back and accept this. Cause all manner of noise about it. Local/national press, radio etc. Name and shame the company behind this dreadful exploitation. Do it here so at least everybody that reads your gripe knows the name of the garage.

So obviously your car was not worth £2000, as the garage would have sold it for that much, and not the £1250 that they got for it. If you had sold it privately in running condition you would have
only got about £900-950. They probably repaired it in the slack times which everybody gets now and then, and you don`t know how much they had to spend on it to get it to a saleable condition,
being a fiat it was brobably a lot. How do you know that they didn`t spend £1000 on parts & labour on it. So why don`t you go to a approved garage and buy a new car and loose £4000 (avg)
as soon as you turn the key and drive off, and yet you will feel as if you havn`t been ripped off !

What constitutes an approved garage? My car broke down in Devon, and I was given the same story. Repairs more than it was worth.
